PLEASE READ THESE TERMS AND CONDITIONS ("THE TERMS AND CONDITIONS") CAREFULLY. THEY SET OUT THE TERMS UNDER WHICH YOU MAY USE THE motorjunction.com website ("THE WEBSITE"). PLEASE ALSO READ THE PRIVACY POLICY ON THE WEBSITE ("THE PRIVACY POLICY") AND ANY OTHER TERMS AND CONDITIONS ON THE WEBSITE (WHICH FORM PART OF THE TERMS AND CONDITIONS).

Ownership of the Website

The Website is owned and operated by EASYSALVAGE LTD t/a Motorjunction.com   ("Motorjunction") . Motorjunction can be contacted at The Flatts, Whitworth Close, Darlaston, Wednesbury, WS10 8LJ, telephone 0121 568 8562, e-mail info@motorjunction.com .

The Website is the sole property of Motorjunction and all intellectual property rights in the Website belong exclusively to it or its licensors. Any trademarks used on the Website but belonging to a third party remain the property of that third party.

Registration and obligations of the User

You must register with Motorjunction before using the Website or placing any bids, however you can browse the Website without registering. You must complete an on-line registration form to register. This may be accessed here . Once you have completed the online registration form you will receive an e-mail containing a further form in PDF format. This form must be completed and returned to Motorjunction by post along with a form of identification in order for Motorjunction to verify your identity and set up your account. You will receive an e-mail once your account has been activated. The registration is complete and the contract between you and Motorjunction formed when Motorjunction sends this e-mail to you. You will not be allowed to place bids until your account is activated and Motorjunction reserves the right to refuse to register you and activate your account for any reason whatsoever. You must be over 18 to use the Website and applications to register from those under 18 will be refused.

If any of the information you give us is incorrect or changes, you must notify us immediately by contacting us with the corrected information.

You may not disclose to or share your password with any third parties or use your password for any purpose other than using the Website in accordance with these Terms and Conditions.

Motorjunction may immediately suspend, indefinitely suspend or terminate your registration at any time without giving you a reason whether or not you are in breach of any of these Terms and Conditions.

You must not attempt at any time to do anything which interferes with the proper working of the Website or of any auction or which will put an unreasonable or disproportionately large load on the Website's infrastructure.

You shall not use the Website to transmit or store material which is obscene, racist, threatening, menacing, offensive, defamatory, abusive, in breach of confidence, in breach of any intellectual property right or which is in breach of any applicable law.

Our liability

The Website offers a venue to trade in motor vehicles and associated goods and services. Motorjunction does not own any of the vehicles which are placed for sale on the Website and does not accept payment for any vehicle. Any payments made to Motorjunction are made exclusively for the provision of services by Motorjunction . As such, the Website is purely an advertising medium and so far as is permitted in law, Motorjunction accepts no liability for any items or service advertised on or supplied through the Website.

Pictures and descriptions are by their nature general indications and Motorjunction makes no warranty that any picture or description of any item is accurate or complete. Users are strongly advised to view any vehicle or other item before bidding or agreeing to purchase it. Any warranty as to the suitability, satisfactory quality, fitness for purpose or roadworthiness of any item is hereby expressly excluded so far as is permitted in law and it is your responsibility to ensure that any vehicle you buy is roadworthy before using or reselling the vehicle. It is also your responsibility to ensure that any vehicle purchased has all appropriate documentation and complies with all applicable laws and regulations before selling or using the vehicle.

Motorjunction accepts no liability for any feedback placed on the Website by any user or other person about any person nor for any losses of whatever kind arising from that feedback.

Motorjunction does not guarantee continuous, uninterrupted or secure access to our services, and operation of the Website may be affected by numerous factors outside of our control. Motorjunction accepts no liability to you for any losses of whatever nature you may incur as a result of any aspect of the Website being unavailable for use or not operating in the way you would expect. In particular, Motorjunction accepts no liability for any losses incurred by you as a result of any bid or communication not being received at the Website or by any party advertising an item or service via the Website.

Motorjunction reserves the right to withdraw any auction item or advertisement from the Website at any time for any reason and without notice to you.

Nothing in these Terms and Conditions shall be construed as seeking to exclude liability of Motorjunction for death or personal injury caused by its negligence.

If you are acting in your capacity as a consumer your statutory rights are not affected by these Terms and Conditions.

Accounts

All bids and payments must be in pounds sterling (GBP) (or such other official legal tender as may replace pounds sterling as the official legal tender of England and Wales) and are payable in advance in accordance with the payment terms set out here . There is a minimum charge of £2.00 (or its equivalent) for each transaction made via the Website.

Motorjunction will under no circumstances refund any payment made to it for its services via the website, other than any payment refunded or credited to a seller in response to the registration of a ‘non-paying bidder alert' or any refund it is obliged to make pursuant to the provisions of the Consumer Protection (Distance Selling) Regulations 2000.

VAT will, where appropriate, be charged extra at the appropriate rate in force at the time of the winning bid and will be calculated according to the amount of the winning bid.

Any buyers bidding for items who are resident outside England and Wales shall be responsible for any extra costs or charges which may be incurred as a result of them residing outside England and Wales, for instance any local taxes, levies or customs duties, any shipping and insurance charges and any other charges or costs associated with the importation or exportation of vehicles.

Admin fees are none refundable under any circumstances.

Private Entry Auctions

Please read the Auction Bidding and Buyer's Guide and Auctioneer and Seller's Guide which form part of these Terms and Conditions.

You must not offer for sale, sell, offer to buy, bid for or buy any item which it is illegal to do so according to the laws of England and Wales or the country from which you are accessing the Website. Motorjunction accepts no liability for any item listed on the Website for sale or any damages or losses incurred as a result of the sale/purchase or use of any such items. You are strongly recommended to inspect any vehicle and contact the seller with any questions you may have before making a bid.

If you are the winning bidder in an auction you must contact the seller within 48 hours of the time the auction closes to arrange for payment and delivery. You have a legal obligation to complete the transaction and the seller may take action against you should you choose not to do so. Whether the seller chooses to take such action or not Motorjunction will impose an administration charge of £75 which will be deducted from your on-line account. If you are the winning bidder and you fail to contact the seller within 48 hours the seller may also register a “non paying bidder alert” which may have an adverse effect on your ability to use the website. You agree that this figure represents a realistic estimate of the costs incurred by Motorjunction as a result of your withdrawing from the auction.

The Seller may withhold from sale any number plate attached to or registered as denoting a particular vehicle for any reason but where the seller refuses to transfer any number plate it shall ensure that the vehicle being sold has a valid registration number and plates before it is transferred to the buyer.

If you are a buyer, once you have made a bid you may not retract it and you are bound to complete and pay the amount bid together with any relevant taxes and fees if that bid is the winning bid. If you are a seller, once an auction is completed you are bound to complete and sell the vehicle in question. Any seller withdrawing from an auction after it has completed will be liable to Motorjunction for all the listing fees and administrative fees applicable to the sale of the vehicle.

If you choose not to complete the transaction the seller may, in addition to taking action against you, offer the vehicle to other bidders in the auction (and seek to recover the difference in the amounts of the bids from you) or cancel the contract without any liability to you. Both sellers and buyers should be aware that withdrawing from any auction may result in another person placing negative feedback onto the Website about you which may affect your ability to enter into transactions in the future.

It is your responsibility to review the on-going status of any bid you make. You should not rely on our automated e-mail or SMS system to keep you updated and Motorjunction can accept no liability for any losses incurred as a result of a lost or delayed e-mail or SMS update.

By placing a vehicle on the Website for auction sellers undertake that that vehicle is not simultaneously available for sale through any other medium or outlet.

Motorjunction reserves the right to remove any details or pictures of any auction from its servers at any time after the auction has closed in order to free up space on its servers.

Classified advertisements

Please read the Seller's Guide and Buyer's Guide .

Sellers are solely responsible for the accuracy, legality and completeness of advertisements on the classifieds section of the Website and for ensuring that such advertisements do not infringe the rights of any third party and do not contain any defamatory material and Motorjunction accepts no liability for any listing on the Website.

Motorjunction reserves the right to remove any classified advertisement from the Website for any reason without notice and without liability to any person.

In placing an advertisement within the classifieds' section of the Website you warrant to Motorjunction that it is accurate, legal and complete, does not infringe the rights of any third party and does not contained any defamatory material.

Easysalvage auctions

Please read the Auction Bidding and Buyer's Guide and Auctioneer and Seller's Guide which form part of these Terms and Conditions.

All vehicles offered for sale through the Easysalvage part of the Website are owned and offered for sale by independent vehicle dealers or insurance companies

The description(s) of the vehicle damage are general indications only and are unlikely to be entirely accurate. Unless specifically stated otherwise, the dealer/insurance company offers the vehicles in their current state with no warranty whatsoever as to condition, roadworthiness, or recorded mileage. The vehicles are offered in a damaged or incomplete condition having been the subject of an insurance company total loss or being faulty and the dealer/insurance company and Motorjunction expressly exclude any warranty as to the suitability, satisfactory quality, or fitness for any purpose of any vehicle purchased so far as is permitted in law. It is the responsibility of the successful bidder to ensure that the vehicle is in a roadworthy condition before the vehicle is used or re-sold. Both the dealer/insurance company and Motorjunction strongly advise you to inspect the vehicle and contact the seller with any questions you may have before making a bid. If you wish to view any vehicle you may contact the storage agent or the seller and they will tell you where it can be viewed.

The dealer/insurance company does not supply existing Vehicle Registration Documents (V5s) or MOT certificates with the vehicles unless it is specifically stated in the vehicle details that they will be provided. However the dealer/insurance company will notify DVLA of the change of ownership to the winning bidder. The name and address notified to the DVLA will be the full name and address given when you registered on the Website. The dealer/insurance company reserves the right to withhold from sale any number plate attached to or registered as denoting a particular vehicle for any reason and it shall be the buyer's responsibility to ensure that the vehicle has a valid registration number and plates attached at the point where ownership transfers.

The dealer/insurance company and Motorjunction reserve the right to cancel any auction being conducted on the Easysalvage part of the Website at any stage before the close time.

If you are the winning bidder on an auction you must contact the seller within 48 hours of the time the auction closes to arrange payment and delivery. You have a legal obligation to complete the transaction and the seller may take action against you should you choose not to do so. Motorjunction will in any event impose an administration charge of 10% of the sale price and a minimum of £75.00 which will be deducted from your on-line account. If you are the winning bidder and you fail to contact the seller within 48 hours the seller may also register a “non paying bidder alert” which may have an adverse effect on your ability to use the website. You agree that this figure represents a realistic estimate of the costs incurred by Motorjunction as a result of your withdrawing from the auction.

You have 5 days to make full payment & arrange collection or delivery, if no full payment is made any deposit will be used to cover cost incurred

If you choose not to complete a transaction the seller may, in addition to taking action against you, offer the vehicle to under bidders (and seek to recover the difference in the amounts of the bids from you) or cancel the contract without any liability to you.

Once you have made a bid you may not retract it and you are bound to complete and pay the amount bid together with any relevant taxes and fees if that bid is the winning bid.

It is your responsibility to review the on-going status of any bid you make. You should not rely on our automated e-mail system to keep you updated and neither Motorjunction nor the dealer/insurance company can accept any liability for any losses incurred as a result of a lost or delayed e-mail update.

When bidding on auctions you agree to the following:-

All auctions are on approval.

Once the auction closes you will receive a Auction Pending email this not proof of purchase, it is simply notification of an auctions Pending Status. Once approved the item is classed as sold a deposit & admin fee payments will be processed then you'll receive your Auction Won email .

The recorded mileage/damage has not been verified, please look at photos for for idea of damage such as suspension etc. The accuracy of this information cannot be relied upon.

UNRECORDED MEANS UNRECORDED ON HPI WHEN CHECKED

PAYMENT DETAILS:- DEPOSIT IS REQUIRED WITHIN 48 HOURS & FULL PAYMENT IN 5 DAYS

Storage will be free for 7 days after the close date, then it will be charged at £5.00 a day

The close time is a guide ending time & is not set in stone, if you bid within the last 3 minutes of the auction it will be extend by another 2 minutes as it is a live auction not closed bids.

You will bring winning e-mail with you on collection of item.

The buyer is required on delivery or collection of item/s to inform the seller of any problems. Compensation & Refunds will not be given after this day, as it will be deemed the buyer has accepted the item/s, The buyer should also be aware if he has nominated a third party to receive or collect the car it is then this third party persons responsibility to check the item/s on your behalf

Vehicle Categories Explained

Car insurance assessors use various categories of car insurance write-off to rank the seriousness of accident damage. Two categories represent very serious damage, but the remaining two categories are for 'economic write-offs' – where damage is expensive to fix but not dangerous.

We don't auction or sell

Category A: scrap only. For cars so badly damaged they should be crushed and never re-appear on the road. Even salvageable parts must be destroyed.

Category B: body shell should be crushed. Signifies extensive damage, although some parts are salvageable. Should never re-appear on road, although reclaimed parts can be used in other road-going vehicles.

We only auction:

Category C: the vehicle is repairable but the costs exceed the vehicle’s value. Can re-appear on road.

Category D: the vehicle is repairable but repair costs are significant compared to the vehicle value – including time delays to source parts. Can re-appear on road.

Category S: the vehicle is repairable but is structurally damaged. Can re-appear on road.

Category N: he vehicle is repairable but is non-stucturally damaged. Can re-appear on road.

Category X: This covers any vehicle that is not currently involved in a total loss, these vehicles are used not currently salvage, they are used but maybe faulty. Mostly they are HPI clear (UNRECORDED) but these vehicles may have been subject to a Total loss in their past, these will be marked on the auction as Previous Total Loss.

The ABI Salvage Code dictates that Category A and Category B cars should be crushed, with Cat B vehicles allowed to donate some safe and serviceable parts.

Privacy

Motorjunction has a firm commitment to only deal with your personal data in accordance with the Data Protection Act 1998 and our Privacy Policy . By submitting your personal data to us you are deemed to have read and accepted the terms of the Privacy Policy .

Notices

Except as explicitly stated otherwise, any notices given by you by e-mail should be addressed to info@motorjunction.com. Any notices given by us to you will be addressed to your registered e-mail address. Such notice shall be deemed to have been given and received 24 hours after the e-mail is sent, notwithstanding the fact that the sending party may be notified that the e-mail address is invalid for any reason (including the possibility that the e-mail address in your registration details is incorrect or out of date). Alternatively, Motorjunction may give you notice by registered post to the address provided to us during the registration processes and you may give us notice by registered post to our registered office. In such case, notice shall be deemed to have been given and received 3 days after the date of mailing.

Variations

Motorjunction reserves the right to vary these Terms and Conditions from time to time. Such changes shall either be notified to you by e-mail or posted on the Website. Such changes in this manner shall be deemed to have been accepted by you if you continue to use the Website after a period of two weeks from the date of transmission of the e-mail or of the posting on the Website, whichever occurs later.

Contracts (Rights of Third Parties) Act 1999

Except as expressly provided in these Terms and Conditions, a person who is not a party to the Terms and Conditions shall have no rights under the Contracts (Rights of Third Parties) Act 1999 to rely upon or enforce any term of these Terms and Conditions provided that this does not affect any right or remedy of the third party which exists or is available apart from that Act. Notwithstanding the provisions of this clause, T L Harvey Limited shall have the right to enforce any term of this Agreement jointly with or separately from any action which Motorjunction may take.

Entire Agreement

These Terms and Conditions contain the entire agreement and understanding of the parties in connection with the use of the Website. This acknowledgement shall not apply to any misrepresentations and/or breaches of warranty which constitute fraud.

Severability

If any term or provision in these Terms and Conditions shall be held to be illegal or unenforceable in whole or in part under any enactment or rule of law such term or provision or part shall to that extent be deemed not to form part of these Terms and Conditions but the validity and enforceability of the remainder of these Terms and Conditions shall not be affected.

Waiver and cumulative remedies

No failure to exercise or delay in exercising any right or remedy under this Agreement shall constitute a waiver thereof and no waiver by Motorjunction of any breach or non-fulfilment by you of any provision of these Terms and Conditions shall be deemed to be a waiver of any subsequent or other breach of that or any other provision hereof. No single or partial exercise of any right or remedy under this Agreement shall preclude or restrict the further exercise of any such right or remedy and the rights and remedies of Motorjunction provided in these Terms and Conditions are cumulative and not exclusive of any rights and remedies provided by law.

Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales . Each of the parties hereby irrevocably submits to the exclusive jurisdiction of the courts of England and Wales .
